Please read all these Terms and Conditions.
EGM Group Ltd — Terms and Conditions of Sale
Please read these Terms and Conditions before placing an order. When we accept your order, they form part of the legally binding agreement between you and EGM Group Ltd and explain how we will process and deliver it. If you are not sure about anything, please contact us.
Application
- These Terms and Conditions will apply to the purchase of the goods by you (the Customer or you). We are EGM Group Ltd whose trading name is EGM Shop a company registered in England and Wales under number: 15700906. Whose registered office is at Unit 5c, Hambleton Grove Industrial Estate, Knaresborough, HG5 0DB, United Kingdom. With our main email address sales@egmshop.co.uk; telephone number 01423398282; (the Supplier or us or we).
- These are the terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions. By ordering any of the Services, you agree to be bound by these Terms and Conditions. You can only purchase the Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.
Interpretation
- Consumer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession.
- Contract means the legally binding agreement between you and us for the supply of the goods.
- Delivery Location means the Supplier’s premises or other location where the Goods are to be supplied, as set out in the Order.
- Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored.
- Goods means the goods advertised on the Website that we supply to you of the number and description as set out in the Order.
- Order means the Customer’s order for the Goods from the Supplier as submitted following the step by step process set out on the Website.
- Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website.
- Website means our website https://www.egmshop.co.uk/ on which the Goods are advertised.
Goods
- The Goods must match the description and specifications agreed in your Order. Product photographs are intended to show appearance, although colours may look different on different screens and natural or handmade elements may vary slightly. We will tell you if a material change to the agreed specification is needed and will seek your agreement before supplying it. This does not affect your legal rights if the Goods do not match their description or agreed specification.
- In the case of any Goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
- All Goods which appear on the Website are subject to availability.
- We can make changes to the Goods which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
Bespoke orders, proofs and customer-supplied artwork
G1. Final approval. If we provide an artwork proof or specification for a custom product, please check its wording, spelling, logo, colours, dimensions, layout, fixing details and intended use before approving it. We will manufacture to the final proof and specifications that you approve. Please tell us promptly if anything is wrong or unclear. Approval does not remove our responsibility for manufacturing errors or for goods that do not match the agreed proof or your legal rights.
G2. Later changes. A change requested after approval may require a revised price and timetable. We will tell you the proposed change before proceeding. Once bespoke manufacture has begun, a customer-requested cancellation or amendment may not be possible, subject to the cancellation and other rights set out elsewhere in these terms.
G3. Rights to artwork. If you supply a logo, photograph, design, wording or other material for us to reproduce, you confirm that you own it or have permission for the use you request. You give us permission to use it to prepare your proof and fulfil the order. If a credible rights complaint arises, we may pause the affected work while we discuss an authorised replacement with you and any resulting change to the timetable. We will not use your supplied material for unrelated marketing without separate permission.
Personal Information
- We retain and use all information strictly under the Privacy Policy.
- We may contact you by email, telephone or post about your order, delivery or a related service issue. Our use of your details for marketing is covered separately by our Privacy Policy and applicable marketing rules; placing an order does not, by itself, mean that you have consented to marketing.
Basis of Sale
- The description of the Goods in our website does not constitute a contractual offer to sell the Goods. When an Order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.
- The Order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
- A Contract will be formed for the sale of Goods ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order you agree to us giving you confirmation of the Contract by means of an email with all information in it (ie the Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the delivery of any Goods supplied under the Contract.
- No variation of the Contract, whether about description of the Goods, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.
- These Terms and Conditions apply to both Consumers and customers purchasing wholly or mainly for business purposes, except where a provision is expressly stated to apply to one group only. The consumer delivery remedies under “Delivery”, the statutory cancellation provisions under “Withdrawal, Returns and Cancellation” through “Returning Goods”, the “Conformity” provisions and the consumer-specific wording in “Excluding Liability” apply only to Consumers. Business customers should also read “B2B sales”, “Business delivery deadlines, priority services and installer bookings”, and, if purchased, “Fast LED Service — business orders”. Whether an order is a business purchase depends on the purpose for which it is made; a business name in a billing or delivery address is not conclusive. If we separately agree written terms for a business order, those terms will take precedence to the extent of any inconsistency.
Price and Payment
- The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the Order or such other price as we may agree in writing.
- Prices and charges include VAT at the rate applicable at the time of the Order.
- You must pay by one of the methods offered at checkout or otherwise agreed with us. We may take payment when the Order is placed or as otherwise stated in the accepted payment terms.
Delivery
- We will deliver the Goods, to the Delivery Location by the time or within the agreed period or, failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the Contract is entered into.
- In any case, regardless of events beyond our control, if we do not deliver the Goods on time, you can (in addition to any other remedies) treat the Contract at an end if:
- we have refused to deliver the Goods, or if delivery on time is essential taking into account all the relevant circumstances at the time the Contract was made, or you said to us before the Contract was made that delivery on time was essential; or
- after we have failed to deliver on time, you have specified a later period which is appropriate to the circumstances, and we have not delivered within that period.
- If you treat the Contract at an end, we will (in addition to other remedies) promptly return all payments made under the Contract.
- If you were entitled to treat the Contract at an end, but do not do so, you are not prevented from cancelling the Order for any Goods or rejecting Goods that have been delivered and, if you do this, we will (in addition to other remedies) without delay return all payments made under the Contract for any such cancelled or rejected Goods. If the Goods have been delivered, you must return them to us or allow us to collect them from you and we will pay the costs of this.
- If any Goods form a commercial unit (a unit is a commercial unit if division of the unit would materially impair the value of the goods or the character of the unit) you cannot cancel or reject the Order for some of those Goods without also cancelling or rejecting the Order for the rest of them.
- We do not generally deliver to addresses outside England and Wales, Scotland, Northern Ireland, the Isle of Man and the Channel Islands. If, however, we accept an Order for delivery outside that area, you may need to pay import duties or other taxes, as we will not pay them.
- You agree we may deliver the Goods in instalments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.
- If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.
- The Goods will become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the Goods before accepting them.
Delivery problems and installation (all customers)
D1. Problems on arrival. Please tell us as soon as reasonably practicable if an item is missing, damaged in transit or appears faulty. Photographs of the item and packaging, and retaining the packaging while we investigate, can help us resolve the issue with the carrier. These requests do not set a deadline for a consumer claim or take away any legal rights. If we arranged delivery to a consumer, we remain responsible for the goods until the risk passes under applicable law. Business customers should inspect deliveries promptly and let us know about visible damage or shortages without undue delay; concealed faults should be reported when discovered.
D2. Faults and remedies. Please contact us with your order details if the goods are faulty or do not match the agreed specification. We will assess the issue and provide the repair, replacement, refund or other remedy required by the contract and applicable law. For consumer orders, we will meet reasonable return or collection costs where the law requires us to do so. The bespoke nature of a product does not remove rights relating to faulty or misdescribed goods.
D3. Installation and use. Installation is included only where expressly stated in the accepted order. If you arrange installation yourself, please follow the instructions supplied with the goods, check that the mounting surface and electrical supply are suitable, and use an appropriately competent installer where the work requires one. Any indoor or outdoor use must comply with the product’s stated rating and instructions. We are not responsible for damage caused solely by incorrect installation, misuse or unauthorised modification; this does not affect your rights if the goods or any installation we supplied were faulty or below the standard required by law.
Fast LED Service (where purchased)
The following Fast Service terms apply only where a Fast Service upgrade is shown on the order and accepted by EGM Group Ltd. They supplement the other terms on this page. The consumer terms apply to individuals buying wholly or mainly outside their trade, business, craft or profession. The business terms apply to orders placed wholly or mainly for business purposes. Where these Fast Service terms conflict with a general term on this page, the applicable Fast Service term governs the Fast Service element, but it does not remove any statutory right or liability that cannot lawfully be restricted.
Fast LED Service — consumer orders
C1. Timescale and start date. We understand that you may need your LED sign for a particular date, and we will make reasonable efforts to meet it. Fast Service provides priority manufacture and expedited delivery, with a target of 3–5 working days from final order approval to delivery. The clock starts when we have received payment, the information needed to manufacture the sign, and your approval of the final artwork and specifications. A change you request afterwards may change the timescale; we will tell you if it does. Working days exclude Saturdays, Sundays and UK bank holidays unless agreed otherwise in writing.
C2. Important dates. The 3–5 working day target is an estimate unless we expressly agree a firm delivery date with you in writing. Please tell us before ordering if a particular event or installation date is essential. Our use of the word “target” does not override any delivery date or period we agree with you, or your statutory rights where delivery by a particular date is essential.
C3. Courier delivery. We normally use a premium next-working-day or comparable courier service for Fast Service orders. We will help trace a delayed parcel and deal with the courier as appropriate. We remain responsible for delivery in accordance with your legal rights; dispatching the sign does not, by itself, transfer the risk of loss to you. If you commission your own carrier and it was not one of the options we offered, different statutory risk rules may apply.
C4. Delays and the Fast Service charge. If a delay within our reasonable control means we cannot manufacture or dispatch your order in time to meet the Fast Service target, we will refund the Fast Service upgrade charge you paid. If the delay is caused by the courier, please contact us promptly so that we can investigate. We will seek any eligible refund of a courier upgrade you specifically paid for and pass on any amount recovered that relates to that upgrade. These arrangements are in addition to, and do not limit, your legal rights if your goods are late, lost, damaged, faulty or not as described. We will not make your statutory remedies dependent on a successful courier claim.
C5. Delivery details and access. Please provide a complete, accurate delivery address, contact details, opening hours and any access restrictions before dispatch. If delivery is delayed because the information you supplied was incorrect or incomplete, the recipient was unavailable, or you requested a change after dispatch, the Fast Service target may need to be revised. We may charge reasonable additional delivery or storage costs caused by those circumstances, where applicable. Please let us know as soon as possible about a delivery problem so we can help resolve it.
C6. Bespoke goods. A sign made to your approved wording, artwork, dimensions or other personal specifications will generally be exempt from the normal distance-selling change-of-mind cancellation right. Please check the proof carefully before approving it. This does not affect your rights where the goods are faulty, do not match the agreed specification, or are not delivered in accordance with your legal rights. See “Withdrawal, Returns and Cancellation” and “Delivery” above.
Fast LED Service — business orders
B1. Timescale and approval. We will make reasonable efforts to meet your requested timescale. Fast Service provides priority manufacture and expedited delivery with a target of 3–5 working days from final order approval to delivery. The period starts only once payment has been received (unless agreed credit terms apply), all required wording, artwork, dimensions, colours and specifications have been confirmed, and you have approved the final design. Changes requested afterwards may extend or restart the period; we will notify you where practicable. Working days exclude Saturdays, Sundays and UK bank holidays unless expressly agreed otherwise in writing.
B2. Critical deadlines. Manufacturing, dispatch and delivery dates are estimates unless we expressly accept a firm contractual delivery date in writing. Time is not of the essence merely because Fast Service has been purchased. You must tell us before placing your order about an event, installation, opening or other critical deadline. Our awareness of that deadline alone does not constitute acceptance of a guaranteed delivery date. Any written agreement of a firm date takes precedence over the target in B1.
B3. Courier delivery. We will normally select a premium next-working-day or comparable expedited courier service. If the sign is completed and handed to the agreed courier in sufficient time to meet the target, a subsequent courier-network delay does not automatically entitle you to a refund of the Fast Service upgrade. We will provide reasonable help to trace the shipment and resolve a delivery issue. This clause does not excuse a delay caused by our own failure to prepare or dispatch the goods in time or override an expressly agreed firm delivery date.
B4. Courier claims. At your request, we will make reasonable efforts to claim an available service refund from the courier if its premium service fails. If we receive a refund specifically relating to a courier upgrade you paid for, we will credit or refund the amount recovered for that upgrade. A courier claim may be refused or may not cover the whole Fast Service charge.
B5. Delays caused by us. If a delay within our reasonable control means we fail to manufacture or dispatch in time to meet the Fast Service target, we will refund the Fast Service upgrade charge you paid, leaving the order at the applicable standard-service price. This is without prejudice to any liability that cannot lawfully be excluded and to any express written agreement we make with you about a firm delivery date.
B6. Delivery information. You must give us a complete address, postcode, contact details, receiving hours and relevant site access instructions before dispatch. We are not responsible for delay caused by inaccurate information, undisclosed restrictions, an unavailable recipient, refusal of delivery or a delivery change you request after dispatch. We may charge reasonable additional courier, storage, correction or redelivery costs attributable to those circumstances.
B7. Installer and event costs. The “Business delivery deadlines, priority services and installer bookings” section below applies to this Fast LED order. It explains the position if you arrange an installer, venue or event before the sign arrives.
B8. Limit on liability for delay. The business delay liability provisions in that section also apply to this Fast LED order, subject to any different terms we expressly agree in writing for a firm delivery deadline.
B9. Bespoke orders and proofs. A sign made to your approved wording, logo, artwork, dimensions, colours or other specifications is bespoke. Once manufacture has started, changes or cancellation require our written agreement, subject to any rights you have if we breach the contract or the goods do not meet the agreed specification. You are responsible for checking the spelling, wording, dimensions, colours and layout in the final proof. We will make the sign to the approved proof, subject to our obligations under the contract.
B10. Events outside our reasonable control. If an event beyond our reasonable control prevents or delays performance, we will tell you as soon as reasonably practicable, take reasonable steps to reduce the effect, and discuss a revised timetable. This includes substantial transport disruption, severe weather, fire, flood, power failure, industrial action or an unforeseeable supply failure. This clause does not excuse a preventable production delay. See “Circumstances Beyond the Control of Either Party” below.
B11. Incorporation. We will make these terms available before you place or approve the Fast Service order. They apply together with the general Terms and Conditions of Sale above and any express written terms agreed for your order.
Business delivery deadlines, priority services and installer bookings (business customers only)
This section applies to business orders for any EGM Group Ltd goods, whether standard or priority service is selected. The additional terms about priority services apply when a priority, express, rush or other paid upgrade is shown on your order and accepted by us. For Fast LED Service, the product-specific target and refund terms above also apply.
P1. Priority targets. A priority upgrade provides the production and/or delivery priority described in your quotation or order confirmation. Its particular target, and what the upgrade covers, will be shown there. A target is measured from the point at which we have received payment (or agreed credit), the final specifications and approvals, and all information needed to fulfil the order, unless we expressly agree a different start point. Any later change you request may affect that target. Buying a priority upgrade does not itself mean that delivery on a particular date is guaranteed. If we fail, for reasons within our reasonable control, to provide an element of the priority upgrade you paid for, we will refund the corresponding upgrade charge. This does not limit any other right that cannot lawfully be restricted or any different remedy expressly agreed in writing.
P2. Essential dates. Please tell us before placing your order if you need the goods for an installation, event or other fixed date. We will only accept a firm contractual delivery deadline if we expressly confirm it in writing. Our awareness of your plans, an estimated arrival date, and the use of an expedited courier do not alone amount to agreement of a guaranteed date. If we agree a firm deadline, the written agreement governs that deadline and any specific allocation of delay risk.
P3. Installers and other third-party bookings. If you arrange your own installer, contractor, venue, equipment hire or event, you are responsible for those arrangements. Please allow time for delivery and inspection before they attend. Unless we expressly agree in writing to accept identified third-party costs, we will not be liable for their call-out, cancellation, rebooking or wasted-labour charges, equipment or access hire, venue charges, cancelled-event costs, travel or accommodation expenses arising from delayed manufacture, dispatch or delivery. This exclusion applies whether a claimed cost is described as direct, indirect or consequential, and whether or not you told us that a booking had been made. We will also not be liable for loss of profit, revenue, business, opportunity or goodwill caused by delay. These exclusions are subject to P4 and to any applicable legal requirement that a limitation be reasonable.
P4. Limit and exceptions. Unless we expressly agree different terms in writing, our total liability to a business customer arising specifically from delayed manufacture, dispatch or delivery will not exceed the total price paid for the affected order. The exclusions and limit in P3 and P4 apply only so far as permitted by law and subject to any applicable requirement of reasonableness. They do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. If a delay occurs, both parties should take reasonable steps to reduce avoidable loss.
Risk and Title
- Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you.
- You do not own the Goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the Goods still owned by you, in which case you must return them or allow us to collect them.
Withdrawal, Returns and Cancellation
- You can withdraw the Order by telling us before the Contract is made, if you simply wish to change your mind and without giving us a reason, and without incurring any liability.
- This is a distance contract (as defined below) which has the cancellation rights (Cancellation Rights) set out below. These Cancellation Rights, however, do not apply, to a contract for the following goods (with no others) in the following circumstances:
- goods that are made to your specifications or are clearly personalised.
- goods which are liable to deteriorate or expire rapidly.
- Also, the Cancellation Rights for a Contract cease to be available in the following circumstances:
- in the case of any sales contract, if the goods become mixed inseparably (according to their nature) with other items after delivery.
Right to Cancel
- Subject as stated in these Terms and Conditions, you can cancel this contract within 28 days without giving any reason.
- The cancellation period will expire after 28 days from the day on which you acquire, or a third party, other than the carrier indicated by you, acquires physical possession of the last of the Goods. In a contract for the supply of goods over time (ie subscriptions), the right to cancel will be 28 days after the first delivery.
- To exercise the right to cancel, you must inform us of your decision to cancel this Contract by a clear statement setting out your decision (eg a letter sent by post or email). You can use the attached model cancellation form, but it is not obligatory. In any event, you must be able to show clear evidence of when the cancellation was made, so you may decide to use the model cancellation form.
- You can also electronically fill in and submit the model cancellation form or any other clear statement of the Customer’s decision to cancel the Contract on our website https://www.egmshop.co.uk/. If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation in a Durable Medium (eg by email) without delay.
- To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of Cancellation in the Cancellation Period
- Except as set out below, if you cancel this Contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
Deduction for Goods Supplied
- We may make a deduction from the reimbursement for loss in value of any Goods supplied, if the loss is the result of unnecessary handling by you (ie handling the Goods beyond what is necessary to establish the nature, characteristics and functioning of the Goods: eg it goes beyond the sort of handling that might be reasonably allowed in a shop). This is because you are liable for that loss and, if that deduction is not made, you must pay us the amount of that loss.
Timing of Reimbursement
- If we have not offered to collect the Goods, we will make the reimbursement without undue delay, and not later than:
- 14 days after the day we receive back from you any Goods supplied, or
- (if earlier) 14 days after the day you provide evidence that you have sent back the Goods.
- If we have offered to collect the Goods or if no Goods were supplied, we will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this Contract.
- We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
Returning Goods
- If you have received Goods in connection with the Contract which you have cancelled, you must send back the Goods or hand them over to us at Unit 5c, Hambleton Grove Industrial Estate, Knaresborough, HG5 0DB, United Kingdom without delay and in any event not later than 14 days from the day on which you communicate to us your cancellation of this Contract. The deadline is met if you send back the Goods before the period of 14 days has expired. You agree that you will have to bear the cost of returning the Goods.
- For the purposes of these Cancellation Rights, these words have the following meanings:
- distance contract means a contract concluded between a trader and a consumer under an organised distance sales or service-provision scheme without the simultaneous physical presence of the trader and the consumer, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded;
- sales contract means a contract under which a trader transfers or agrees to transfer the ownership of goods to a consumer and the consumer pays or agrees to pay the price, including any contract that has both goods and services as its object.
B2B sales (business customers only)
- A business order is one placed wholly or mainly for trade, business, craft or professional purposes. Please tell us when ordering if you are purchasing for your business; a business name or delivery address alone does not determine your legal status.
- Cancellation or changes after order acceptance: Business customers do not have an automatic right to cancel an accepted order simply because they change their mind. If, before manufacture or dispatch, we agree at your request to cancel an accepted order or remove items from it, we may deduct the non-refundable payment processing fees actually charged to us by the payment provider for the cancelled order or items, up to a maximum of 4% of the amount refunded. This can apply to card, PayPal or Klarna payments, but only where the payment has been captured and non-refundable fees have actually been incurred. It does not apply to payments made by bank transfer or cash. We will explain the deduction and provide a breakdown on request. We will not make this deduction if cancellation or a full refund is due because of our breach of contract or because the law requires it. If you remove items but keep the rest of the order, we will send an updated order confirmation. Once manufacture of bespoke goods has begun, our bespoke order terms also apply.
- Returns after dispatch: Business customers do not have a statutory change-of-mind cancellation right. If we agree to accept a return, a restocking fee of up to 20% of the amount otherwise refundable may apply; this includes any applicable payment processing fee mentioned above, without charging it twice. We will confirm the applicable fee when agreeing to the return. These fees do not apply where the goods fail to meet the contract or where a refund is otherwise legally due.
Conformity
- We have a legal duty to supply the Goods in conformity with the Contract, and will not have conformed if it does not meet the following obligation.
- Upon delivery, the Goods will:
- be of satisfactory quality;
- be reasonably fit for any particular purpose for which you buy the Goods which, before the Contract is made, you made known to us (unless you do not actually rely, or it is unreasonable for you to rely, on our skill and judgment) and be fit for any purpose held out by us or set out in the Contract; and
- conform to their description.
- It is not a failure to conform if the failure has its origin in your materials.
Successors and Our Sub-Contractors
- Either party can transfer the benefit of this Contract to someone else, and will remain liable to the other for its obligations under the Contract. The Supplier will be liable for the acts of any sub-contractors who it chooses to help perform its duties.
Circumstances Beyond the Control of Either Party
- In the event of any failure by a party because of something beyond its reasonable control:
- the party will advise the other party as soon as reasonably practicable; and
- the party’s obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer’s above rights relating to delivery and any right to cancel, below.
Privacy
- Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.
- These Terms and Conditions should be read alongside, and are in addition to our policies, including our Privacy Policy.
- For the purposes of these Terms and Conditions:
- ‘Data Protection Laws’ means any applicable law relating to the processing of Personal Data, including, but not limited to the UK GDPR.
- ‘GDPR’ means the UK General Data Protection Regulation.
- ‘Data Controller’, ‘Personal Data’ and ‘Processing’ shall have the same meaning as in the GDPR.
- We are a Data Controller of the Personal Data we Process in providing Goods to you.
- Where you supply Personal Data to us so we can provide Goods to you, and we Process that Personal Data in the course of providing the Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
- before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected.
- we will only Process Personal Data for the purposes identified;
- we will respect your rights in relation to your Personal Data; and
- we will implement technical and organisational measures to ensure your Personal Data is secure.
- For any enquiries or complaints regarding data privacy, you can e-mail: sales@egmshop.co.uk
Excluding Liability
- For Consumer orders, we do not exclude liability for fraud or fraudulent misrepresentation, death or personal injury caused by our negligence, or any liability which cannot legally be excluded. Subject to your legal rights, we are not responsible for losses that were not reasonably foreseeable to both parties when the Contract was made, or for losses arising from business use of Goods purchased as a Consumer. For Fast Service business orders, see the specific terms on delay and liability above.
Governing Law, Jurisdiction and Complaints
- The Contract (including any non-contractual matters) is governed by the law of England and Wales.
- Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.
- We try to avoid any dispute, so we deal with complaints in the following way: If a dispute occurs customers should contact us to find a solution. We will aim to respond with an appropriate solution within 7 days.
